AutoFixNaija Mechanic Agreement (Independent Contractor Agreement)

This Mechanic Agreement (“Agreement”) is entered into between AutoFixNaija Solutions ("AutoFixNaija", "we", "our", or “the Platform”) and the individual or business registering as a mechanic (“Mechanic”, "you", or "your").

By registering on AutoFixNaija, accessing mechanic features, or accepting service requests, you confirm that you have read, understood, and agreed to this Agreement.

1. Independent Contractor Relationship

You acknowledge and agree that:

• You are an independent contractor and not an employee, agent, partner, or representative of AutoFixNaija.
• You are solely responsible for your services, compliance with local laws, licenses, permits, insurance (if applicable), pricing, tools, and workmanship.
• AutoFixNaija does not control how you perform repairs, set schedules, deliver services, or the methods you use.
• Nothing in this Agreement creates an employment, partnership, or agency relationship between you and AutoFixNaija.

2. Scope of Services

AutoFixNaija provides a digital platform that connects vehicle owners with mechanics.

• AutoFixNaija does not perform repairs
• AutoFixNaija does not supervise work
• AutoFixNaija does not guarantee job volume

You are responsible for:

• Diagnosing vehicles
• Providing accurate service descriptions and estimates
• Complying with local laws and licensing requirements
• Commmunicating clearly with customers
• Performing repairs professionally and safely

3. Mechanic Responsibilities

You agree to:

• Provide accurate information about your skills, location, and services
• Quote honest and transparent pricing
• Upload truthful photos or videos of repairs when required
• Treat customers with respect and professionalism
• Comply with all applicable laws, regulations, and industry standards

Misrepresentation, fraud, unsafe practices, or violations of this Agreement may result in suspension or termination of your account.

4. Estimates, Pricing, and Payments

• You control your service pricing.
• Estimates must be approved by customers before work begins.
• Payments may be processed through third-party providers.
• AutoFixNaija may deduct: platform commission, subscription fees, and promotional fees (if applicable).

AutoFixNaija is not responsible for customer non-payment outside platform-processed transactions.

5. Reviews, Ratings, and Reputation

• Customers may leave reviews and ratings.
• AutoFixNaija may display reviews publicly.
• Reviews reflect customer opinions, not platform endorsements.

AutoFixNaija may remove content that is abusive, fraudulent, or violates platform policies.

6. Liability and Disclaimer

You agree to:

You are solely responsible for the quality and safety of your work

AutoFixNaija is not liable for:

• Vehicle damage
• Personal injury
• Financial loss
• Disputes arising from repairs
• Third-party services or products
• Customer dissatisfaction

You agree to indemnify and hold harmless AutoFixNaija from claims related to your services.

7. Insurance & Compliance

Where required by law or best practice, you are responsible for maintaining appropriate insurance coverage.

AutoFixNaija does not provide insurance on your behalf.

8. Platform Use and Termination

AutoFixNaija may suspend or terminate your access if you:

• Violate this Agreement
• Receive repeated customer complaints
• Engage in fraud or misconduct
• Damage the platform’s reputation

You may stop using the platform at any time.

9. Intellectual Property

AutoFixNaija owns all platform software, branding, and systems.

You may not copy, resell, or misuse platform assets.

Repair photos you upload may be used for:

• Platform marketing
• job record
• Disputes resolutions
• Platform improvement (non-exclusive use)

10. Governing Law

This Agreement shall be governed by applicable laws based on the region of operation, including but not limited to Nigeria and Gambia, with consideration for international platform operations

11. Changes to This Agreement

AutoFixNaija may update this Agreement from time to time.

Continued use of the platform after updates indicates acceptance of the revised terms.

12. Acceptance

By registering as a mechanic on AutoFixNaija, you confirm that:

• You have read and understood this Agreement
• You agree to be legally bound by the terms of this Agreement
• You agree to comply with all applicable laws and regulations
• You agree to indemnify and hold harmless AutoFixNaija from any claims or damages arising from your use of the platform
