Terms of Service

Welcome to AutoFixNaija (“AutoFixNaija,” “we,” “our,” or “us”). By accessing or using our website, applications, or services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Platform Role and Disclaimer

AutoFixNaija is a technology platform that connects vehicle owners (“Customers”) with independent mechanics (“Mechanics”). AutoFixNaija does not provide vehicle repair services, does not employ Mechanics, and does not guarantee the quality, safety, legality, or outcome of any services provided. All Mechanics operate as independent contractors and are solely responsible for their services, compliance with local laws, licenses, insurance, pricing, and workmanship.

2. Eligibility and Accounts

You must provide accurate, complete, and current information when using the Service. AutoFixNaija reserves the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in harmful or unlawful conduct.

3. Customer Responsibilities

Customers agree to:

• Provide accurate vehicle and service details
• Review estimates before approving work
• Inspect completed repairs before final acceptance
• Resolve disputes directly with Mechanics when possible

4. Mechanic Responsibilities

Mechanics agree to:

• Provide accurate and honest service descriptions and pricing
• Perform work according to agreed-upon terms
• Perform services in a professional and timely manner
• Resolve disputes in good faith with Customers
• Communicate clearly with Customers throughout the repair process
• Maintain required licenses, permits, and insurance
• Comply with local laws and regulations
• Maintain professional standards and safety practices

5. Payment and Fees

Payments may be processed through third-party providers. AutoFixNaija may charge commissions, service fees, or platform fees as described on the Pricing page or within the Service. AutoFixNaija is not responsible for payment disputes between Customers and Mechanics beyond the platform’s stated processes.

Final repair payments for jobs booked through the Service are processed through the Service's payment provider. Payments are automatically split: AutoFixNaija's service commission is deducted, and the remaining balance is settled to the Mechanic's registered account. The commission rate is communicated through the Service and may be updated with reasonable notice.

6. Callout / Booking Deposit

To confirm a booking, Customers pay a refundable callout deposit through the Service. This deposit secures the Mechanic's commitment to attend and inspect the vehicle, and is credited toward the Customer's final repair bill.

• If the Customer proceeds with the repair, the deposit is credited toward (deducted from) the final bill.
• If the Customer chooses not to proceed after the Mechanic has attended and inspected the vehicle, the deposit compensates the Mechanic for the callout and inspection, less a platform service portion, and is not refunded.
• If the Mechanic fails to attend or is unavailable, the deposit is refunded to the Customer in full.

The specific deposit amount and any applicable splits are shown on the Service and may be updated with reasonable notice.

7. No Warranties

The Service is provided “as is” and “as available.” AutoFixNaija makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, AutoFixNaija shall not be liable for:

• Personal injury, property damage, or vehicle damage
• Lost profits, data loss, or indirect damages
• Actions or omissions of Mechanics or Customers

AutoFixNaija’s total liability shall not exceed the amount paid to AutoFixNaija for the Service in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless AutoFixNaija, its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses arising out of:

• Your use of the Service
• Your violation of these Terms
• Your breach of any representation or warranty made to AutoFixNaija
• Your violation of any third-party rights
• Your interaction with other users of the Service
• Your violation of any applicable laws, rules, or regulations

10. Governing Law and Dispute Resolution

AutoFixNaija Solutions operates from the United States, with its service and target market in the Federal Republic of Nigeria. These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, where the Service is provided, without regard to conflict of laws principles. We handle personal data in line with applicable Nigerian data protection law, including the Nigeria Data Protection Regulation (NDPR). Disputes shall be resolved through good-faith negotiation before litigation, unless prohibited by law.

11. Modifications

AutoFixNaija may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Acceptance of Terms

By creating an account or using AutoFixNaija, you confirm that you have read, understood, and agreed to these Terms of Service. Acceptance is completed electronically either by creating an account or by selecting the appropriate checkbox during registration. Records of acceptance, including timestamps, may be stored by AutoFixNaija for legal and compliance purposes.
